Welcome to Ekāgra.
These Terms & Conditions (“Terms”) govern your access to and use of the Ekāgra website and your participation in our yoga, meditation, pranayama, wellness classes, private sessions, home-visit sessions, workshops, and related services.
By accessing our website, making a booking, making a payment, or participating in an Ekāgra service, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree with these Terms, please do not use our website or services.
1. Our Services
Ekāgra is a yoga and wellness platform offering practices and programmes designed to support physical wellbeing, mindful living, self-awareness, and personal growth.
Our services may include:
- Online group yoga classes;
- Online private and one-to-one yoga classes;
- Private yoga sessions at the client’s home;
- Pranayama and meditation sessions;
- Women’s wellness sessions;
- Prenatal yoga;
- Postnatal yoga;
- Occasional workshops; and
- Other related yoga and wellness services introduced by Ekāgra from time to time.
Note on Studio Location: Ekāgra does not operate a permanent physical yoga studio, and regular group classes are conducted virtually unless expressly stated otherwise.
Workshops may occasionally be conducted at a physical venue. Details of any such workshop, including the venue, date, time, format, and applicable terms, will be communicated separately at the time of registration.
The availability, schedule, format, duration, instructor, location, and fees of individual services may vary. Ekāgra reserves the right to introduce, modify, reschedule, or discontinue services when reasonably necessary.
2. Registration and Eligibility
To participate in an Ekāgra class, private session, home visit, workshop, or other service, you may be required to provide certain information and complete the applicable registration and payment process.
You agree that all information you provide to Ekāgra is accurate, complete, and current.
Certain services may have specific age, experience, physical, pregnancy-related, or other participation requirements.
Where a participant is a minor or otherwise requires the consent of a parent or legal guardian, the appropriate parent or guardian must provide the required consent before participation.
Ekāgra may decline or restrict participation where a service has specific eligibility requirements or where participation may not be appropriate based on the information reasonably available to us.
3. Bookings
Bookings may be made through the Ekāgra website, booking platform, telephone, messaging service, or any other booking method made available by Ekāgra.
A booking is considered confirmed once the applicable registration process has been completed and, where payment is required, the required payment has been successfully received.
Please review the date, time, format, location where applicable, and other booking details carefully before completing your booking.
Bookings are generally personal to the participant and may not be transferred to another person unless Ekāgra expressly permits the transfer.
4. Online Classes
Ekāgra offers online group and private yoga and wellness sessions.
For online classes, you are responsible for creating a safe and suitable practice environment. You should ensure that you have:
- Adequate space to move safely;
- A suitable and stable surface;
- Appropriate lighting and ventilation;
- Any equipment recommended for the class;
- A suitable device; and
- A reasonably stable internet connection.
Please remove avoidable hazards from your practice area and ensure that your surroundings are reasonably suitable for yoga practice.
For private online sessions, the session time is reserved specifically for the participant. For this reason, the applicable cancellation and rescheduling terms will apply if the participant is unavailable or does not attend.
Ekāgra is not responsible for interruptions caused by your internet connection, device, electricity supply, home environment, or other circumstances outside our reasonable control.
5. Private Home-Visit Sessions
Ekāgra may offer private yoga sessions where an Ekāgra instructor travels to the client’s home or another location agreed upon in advance.
Home-visit sessions are subject to availability and may be limited to specified geographical areas. The client is responsible for providing a reasonably safe, clean, and suitable space for the session.
The client should ensure that:
- There is sufficient space for safe movement;
- The practice area is reasonably free from hazards;
- The floor or surface is suitable for yoga practice;
- Pets or other avoidable distractions are appropriately managed;
- The instructor has safe and reasonable access to the agreed location; and
- Any relevant building, society, security, parking, or access requirements are communicated to Ekāgra in advance.
If the location is reasonably considered unsuitable or unsafe for the instructor or participant, Ekāgra may request that the session be moved, modified, postponed, or cancelled.
Where the client is responsible for providing access to the location and the instructor is unable to enter or conduct the session because appropriate access was not provided, the booking may be treated as a missed session, subject to the applicable cancellation terms.
For the safety and comfort of both the client and instructor, Ekāgra may decline or discontinue a home-visit session where circumstances create a reasonable safety concern.
Home-visit sessions are intended for the individual participant or participants specifically included in the booking. Additional people should not participate unless agreed with Ekāgra in advance.
6. Workshops
Ekāgra may occasionally organise workshops relating to yoga, meditation, pranayama, wellness, or related subjects.
Workshops may be conducted online or, occasionally, at a separately specified physical venue. The details of each workshop, including its date, time, format, venue where applicable, duration, fees, and cancellation conditions, will be communicated at the time of registration. Workshop registrations may be subject to specific terms in addition to these general Terms.
7. Fees and Payments
All applicable fees will be displayed or communicated before you complete a purchase or booking. Payments may be processed through third-party payment gateways or other payment service providers.
You are responsible for providing accurate payment and billing information. Where applicable, taxes and other mandatory charges will be communicated at the time of purchase.
Ekāgra reserves the right to change its fees from time to time. Any change will not affect a booking that has already been confirmed and paid for, unless otherwise communicated or required by applicable law.
8. Cancellations, Rescheduling and Refunds
We understand that plans can change. To keep our classes, private sessions, home visits, and workshops organised and to ensure fairness to both participants and instructors, the following cancellation principles apply.
Cancellation by You: If you need to cancel a booking, please contact Ekāgra as soon as possible through the official contact method provided on our website. Whether a cancellation is eligible for a refund, credit, or rescheduling will depend on the type of service booked and the cancellation conditions communicated at the time of booking.
Late Cancellations: Cancellations made after the applicable cancellation period may not be eligible for a refund or credit. Where appropriate, Ekāgra may offer a rescheduled session or credit at its discretion.
No-Shows and Missed Sessions: If you do not attend an online class, private session, home visit, or workshop without cancelling within the applicable cancellation period, the booking may be treated as a used session and may not be eligible for a refund, credit, or replacement session.
Rescheduling: Where rescheduling is permitted, requests should be made before the applicable cancellation deadline. Rescheduling is subject to instructor and schedule availability.
Refunds: Where you are entitled to a refund under the applicable cancellation terms, the refund will generally be processed through the original payment method or another appropriate method.
9. Packages and Memberships
Where Ekāgra offers packages or memberships, the applicable validity period, number of sessions, inclusions, and other conditions will be communicated at the time of purchase.
Unless expressly stated otherwise:
- Packages and memberships are intended for the registered participant;
- Sessions must be used within the applicable validity period;
- Unused sessions may expire after the validity period;
- Packages may not be exchanged for cash;
- Packages may not be transferred to another person without Ekāgra’s approval; and
- Promotional or discounted packages may have additional conditions.
10. Cancellation or Rescheduling by Ekāgra
While we make reasonable efforts to maintain published schedules, Ekāgra may occasionally need to cancel, postpone, reschedule, or modify a class, private session, home visit, or workshop.
This may happen because of instructor availability, logistical issues, technical difficulties, safety concerns, insufficient registrations, government restrictions, or emergencies. Where Ekāgra cancels a service, we will make reasonable efforts to provide an appropriate alternative.
11. Yoga and Wellness Disclaimer
Medical Notice:
Yoga, pranayama, meditation, movement, and other wellness practices involve physical and mental activity and may involve inherent risks.
Ekāgra’s services are intended for general educational, wellness, fitness, and personal-development purposes. Ekāgra does not provide medical diagnosis, medical treatment, or medical advice.
Our teachers and instructors are not a substitute for a doctor, physiotherapist, psychologist, obstetrician, or other qualified healthcare professional.
You are responsible for determining whether participation in a particular class or programme is appropriate for you. We recommend consulting an appropriately qualified healthcare professional before beginning a new physical or wellness programme if you have any medical condition, injury, physical limitation, pregnancy-related concern, or recent surgery.
12. Your Responsibility During Practice
Every body is different, and yoga should be practised with awareness and respect for your individual limits. You are responsible for listening to your body and practising within your own abilities.
You should stop, rest, or modify a practice if you experience pain, dizziness, discomfort, unusual shortness of breath, or any other concerning symptom. You may choose not to perform any posture, movement, breathing practice, or exercise that does not feel appropriate for you.
You are encouraged to inform your instructor before a session about any relevant injury, physical limitation, pregnancy, postpartum status, or other circumstance that may affect your participation.
13. Prenatal and Postnatal Programmes
Prenatal and postnatal yoga require particular care because every pregnancy and postpartum experience is different.
Participants should seek appropriate guidance from their qualified healthcare professional regarding participation, particularly where there are medical concerns, complications, or restrictions.
Ekāgra’s prenatal and postnatal services are intended to support yoga and wellness practice and are not a substitute for medical care, obstetric care, physiotherapy, or other professional healthcare.
If an instructor reasonably believes that a participant should not continue a particular practice, the participant may be asked to stop, modify the practice, or seek appropriate professional advice before continuing.
14. Respectful Community
Ekāgra aims to create a welcoming, inclusive, and respectful environment. We do not permit harassment, bullying, discrimination, intimidation, threatening or abusive behaviour, sexual misconduct, deliberate disruption, or behaviour that creates a safety concern for another person.
We reserve the right to refuse, suspend, or end participation where reasonably necessary to protect the safety and wellbeing of our community. For home-visit sessions, respectful and professional conduct is expected from both the client and the instructor.
15. Intellectual Property
All original content created or provided by Ekāgra, including its name, logo, branding, website content, written materials, photographs, videos, graphics, class materials, teaching resources, recorded content, and other original materials, is owned by Ekāgra or used with appropriate permission.
You may use Ekāgra materials for your personal learning and participation. You may not copy, reproduce, record, livestream, sell, publish, or commercially exploit our content without prior written permission.
16. Recording, Photography and Content
Participants may not photograph, record, livestream, reproduce, or distribute an Ekāgra class, private session, workshop, or other session without prior permission.
Ekāgra may occasionally photograph or record workshops or other activities for documentation or promotional purposes. Where required, we will seek appropriate permission before using identifiable photographs, videos, testimonials, or other personal content.
17. Testimonials and Reviews
We value feedback from our community. If you voluntarily provide a testimonial, review, photograph, video, or other feedback to Ekāgra, we may use it for legitimate business and promotional purposes where permitted by applicable law.
18. Website Use
You agree to use the Ekāgra website lawfully and responsibly. You must not attempt to gain unauthorised access to our systems, introduce malicious software, or interfere with website security or operation.
19. Third-Party Services
Ekāgra may use third-party services for payments, bookings, communications, online classes, scheduling, analytics, social media, or other business functions. These third parties may have their own terms and privacy policies.
20. Website Availability and Information
We make reasonable efforts to ensure that information published on our website is accurate and current. However, class schedules, instructors, programme details, prices, and workshop venues may occasionally change.
21. Personal Information and Privacy
Your use of our website and services is also subject to our Privacy Policy, which explains how Ekāgra collects, uses, stores, and protects personal information.
22. Limitation of Liability
To the extent permitted by applicable law, Ekāgra will not be responsible for loss or damage arising from circumstances outside our reasonable control or from your failure to follow reasonable instructions or disclose relevant information that may affect your safe participation.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
23. Indemnity
To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, or reasonable expenses arising directly from your unlawful use of Ekāgra’s services, your violation of these Terms, or your intentional or negligent misconduct.
24. Force Majeure
Ekāgra will not be responsible for a delay, interruption, or failure to provide a service where the circumstances arise from events beyond our reasonable control, such as natural events, power failures, or other unforeseen disruptions.
25. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be published on this page with a revised “Last Updated” date. Your continued use of our website or services constitutes acceptance of the revised Terms.
26. Governing Law
These Terms are governed by the applicable laws of India. Subject to applicable law, disputes relating to these Terms will be subject to the jurisdiction of the appropriate courts in India.
27. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted to the extent necessary to make it enforceable, and the remaining provisions will continue to apply.
